HR996, legislation that will,
for the first time, shift regulation of the RTO industry from
the state level to the federal government is slowly gaining
momentum.
HR996 was introduced with just 2 cosponsors compared to HR1701
with 13. After a slow start, 20 cosponsors have signed
onto the bill in the past 11 days, bringing the grand total to
27; 18 Republican and 9 Democrat, including main sponsor
Rep. Walter
Jones (R -NC).

| The meat of the proposed
legislation, widely supported by industry execs, will
require states to recognize the 'non retail' nature of
Rental Purchase. HR996 will preempt states like Wisconsin
and Vermont that, whether through statute or 'legislating
from the bench', view Rent to Own as a credit sale.

So far there are few surprises. The only cosponsor of HR996 that
was not a cosponsor last session is
Rep
Charles Pickering (R-MS). Mr.
Pickering voted in favor of HR1701 but did not co-sponsor the
bill.
RTO Online asked Rep. Pickering's
Communications Director, Brian Perry, what brought about the
increased level of support.

"[Congressman Pickering] cosponsored HR1634, essentially the
same bill in the 106th congress. We supported HR1701 last
session but did not cosponsor the bill because we were not asked
by supporters or constituents." Mr. Perry added, "Congressman
Pickering's co-sponsorship of HR996 shows an increased
awareness."
Notably absent as cosponsors of HR996
are early sponsors of HR1701. Republicans
John Boehner
(R-OH 8th) and
Zach Wamp
(R-TN 3rd), and Democrats
William Jefferson
(D-LA 2nd),
Harold Ford (D-TN 9th)
and Max Sandlin (D-TX 1st).

Granted it's early, HR996 was introduced 2 months earlier in the
session than HR1701, but Democratic support seems to have waned.
Whether a result of timing, a change in Dem leadership, or
lobbyist focus on the majority, time will tell.
