"The Attorney General and the Department of Justice believes this amendment is a positive step for state consumers"
Michael R. Bauer, Administrator of the Division of Legal Services

Wisconsin Attorney General Peg Lautenschlager

The Wisconsin Attorney General softened her position yesterday regarding the Wisconsin Rental Purchase Agreement Act and will end her opposition to the legislation currently pending in both houses of the Wisconsin legislature.

In a letter to Senator Ron Brown, who introduced the Act in the Senate, Michael R. Bauer, Administrator of the Division of Legal Services, a branch of Wisconsin's Department of Justice said "I have been made aware of an amendment that returns regulation of these agreements to the Wisconsin Consumer Act." (see full text below) (see actual memo pdf)

Bauer added "The Attorney General and the Department of Justice believes this amendment is a positive step for state consumers."

Wisconsin Attorney General Peg Lautenschlager had earlier released a statement opposing the bill.

The Joint Finance Committee recommended passage of the Act yesterday by a 12 -4 vote. The Act now goes to the floor of both houses.

Dear Senator Brown: ,
I am aware of your concerns related to the Department’s March 5,2004 statement regarding Senate Bill 486, legislation related to the regulation of rent-to-own agreements. Since the issuance of that statement, I have been made aware of an amendment that returns regulation of these agreements to the Wisconsin Consumer Act. The Attorney General and the Department of Justice believes this amendment is a positive step for state consumers. While the amendment does not extinguish all of the substantive concerns raised by the Department about this legislation, your efforts to improve upon the original proposal are appreciated. If the Department of Justice can be of any further assistance to you with regard to this matter, please feel free to contact our legislative liaison Vaughn Vance. Once again, thank you for this opportunity to clarify the Department’s position regarding this legislation.

Michael R. Bauer
Administrator
Division of Legal Services
